Loi n°21-012/AU du 25 juin 2021 relative à la cybersécurité et à la lutte contre la cybercriminalité

Loi n°21-012/AU of 25 June 2021 on cybersecurity and the fight against cybercrime (relative à la cyber sécurité et à la lutte contre la cybercriminalité) is the Union of the Comoros's principal dedicated cybercrime and cybersecurity statute. Adopted by the Assembly of the Union, it was promulgated by Decree n°22-003/PR of 18 January 2022. The law establishes a national cybersecurity framework and creates a body of cybercrime offences, complementing Chapter IV (Articles 449-505) of the Penal Code, which already addressed certain computer-related conduct. Consistent with the regional model reflected in the African Union's Malabo Convention (which the Comoros has signed), the statute addresses offences against the confidentiality, integrity and availability of computer systems and data - including illegal access, illegal interception, and interference with data and systems - together with computer-related fraud and forgery, the misuse of devices, and content offences such as child pornography and the dissemination of racist or xenophobic material. It also sets out procedural and investigative measures for the search and seizure of computer systems and data, the preservation and production of stored data, real-time collection and interception, and international judicial cooperation, and addresses the obligations of electronic-communications operators and service providers. Enforcement runs through the judicial authorities and the police, supported by the national digital-development and cybersecurity institutions; the Agence Nationale de Développement du Numérique (ANADEN) leads the country's broader digital-governance and code numérique work. As a lower-capacity jurisdiction, the Comoros faces practical constraints on enforcement capacity, and a consolidated digital code was under development as at 2026.
