The Payment System Act, 2014 is Liberia's principal statute on payment, clearing and settlement systems and the legal foundation for the Central Bank of Liberia's (CBL) oversight of digital payments, mobile money and electronic money. Liberia operates a dual-currency economy (Liberian dollar and US dollar) and is outside WAEMU/BCEAO; the CBL is the national regulator. Scope and applicability: The Act empowers the CBL to establish, operate, designate, regulate and oversee payment systems in Liberia, and applies to operators of and participants in payment, clearing and settlement systems, including banks, mobile money providers, electronic money issuers and payment service providers. It provides the statutory basis for the CBL's subsidiary regulations on mobile money and electronic money issuance. Core obligations: The Act requires CBL authorisation/designation for payment systems and providers, provides for settlement finality and the enforceability/irrevocability of payment instructions in designated systems, and confers oversight, standard-setting and sanctioning powers on the CBL. It underpins requirements on safeguarding customer funds, agent networks, interoperability and consumer protection that are detailed in CBL regulations, and supports the operation of the National Electronic Payment Switch (NEPS) and, more recently, an inclusive instant-payment system enabling real-time interoperable transfers among banks and non-banks. Supervision and enforcement: The Central Bank of Liberia designates and oversees payment systems, licenses and supervises providers, issues regulations and directives (including the Mobile Money Regulations and rules on the licensing and operation of electronic payment/e-money services), and may impose corrective measures and sanctions. The Act is the cornerstone of Liberia's payments and fintech regulatory framework.
