The Mozambican Government's draft Cybercrime Law (Proposta de Lei sobre Crimes Cibernéticos), approved by the Council of Ministers on 30 September 2025 and transmitted to the Assembleia da República, is one of two complementary digital-governance bills, the other being the draft Cybersecurity Law (Proposta de Lei da Segurança Cibernética). As at June 2026 neither had been enacted, and this instrument remains a draft. The Cybercrime Law establishes rules applicable to all natural and legal persons, public or private, that use data-communication networks and information systems. It contains both substantive criminal provisions (defining computer-related offences) and procedural provisions, including the collection and admissibility of electronic evidence and mechanisms for international cooperation. The Government has framed the Bill as a response to the "sense of impunity" around cyber offences and as a means of aligning Mozambique's legal framework with international standards. The companion Cybersecurity Law focuses on safeguarding the State, institutions, citizens, information systems and critical infrastructure in cyberspace. Until enactment, computer crimes in Mozambique are prosecuted under general Penal Code provisions, which scholars have noted are only partially adapted to digital offences. The data-protection track is separate: Mozambique has been preparing a Personal Data Protection Law expected around June 2026, recorded elsewhere in this library.
